Creator Agreement

1. What MonkyCards Does

MonkyCards is a platform that creates limited-edition digital collectible cards featuring rising content creators. Each card is limited to 25 copies (Founder Edition) and sold to collectors at $2.99 per card.

2. Rights Granted by the Creator

By entering into this Agreement, the Creator grants MonkyCards a non-exclusive, royalty-free, worldwide license to:

• Use the Creator's name, likeness, image, photo, and social media handle on their MonkyCard
• Display the Creator's MonkyCard on the MonkyCards website and platform
• Use the Creator's name and image in promotional materials for MonkyCards
• List the Creator's card in the Drops section and make it available for purchase

This license terminates upon the Creator's request to be removed from the platform (see Section 5).

3. Creator Stats and Card Content

Each MonkyCard displays a set of creator statistics (e.g. Mindset, Discipline, Impact, Momentum). These stats are assigned by MonkyCards based on publicly available information and internal editorial judgment. They are illustrative and do not represent any official ranking or endorsement.

The Creator acknowledges that MonkyCards retains full editorial control over card design, stats, and presentation.

4. Revenue and Compensation

MonkyCards currently does not pay revenue share to featured creators. Being featured on MonkyCards is offered as a visibility and community-building opportunity.

MonkyCards reserves the right to introduce a revenue share model in the future. If introduced, existing creators will be notified and offered updated terms. Creators are not entitled to any portion of card sale revenue under the current terms unless a separate written agreement is in place.

5. Creator Removal and Card Retirement

The Creator may request removal from the MonkyCards platform at any time by contacting info@monkycards.de. Upon a valid removal request:

• The Creator's card will be retired from active sale within 7 business days
• No new copies of the card will be sold
• Existing card holders retain their cards permanently — cards already sold cannot be recalled
• The Creator's profile and image will be removed from the active Drops section
• The Creator's card may remain visible in Collector Profiles and on the Collector Wall as part of existing collections

MonkyCards reserves the right to retire a Creator's card at its own discretion if the Creator's public conduct violates applicable laws, incites harm, or is seriously detrimental to the MonkyCards platform or its users.

6. Creator Representations and Warranties

By entering into this Agreement, the Creator confirms that:

• They are at least 18 years of age, or have obtained verifiable parental or guardian consent
• They own or control all rights to the images and content submitted to MonkyCards
• The submitted materials do not infringe any third-party intellectual property rights
• They have not entered into any exclusive agreement that would prohibit their participation on MonkyCards
• The information provided during application is accurate and truthful

7. Data Processing — Creator Personal Data

By applying and being featured on MonkyCards, the Creator's name, image, social media handle, and card statistics will be publicly displayed on the MonkyCards platform. This data is processed on the basis of this Agreement (Art. 6 Para. 1 lit. b GDPR) and the Creator's explicit consent (Art. 6 Para. 1 lit. a GDPR).

The Creator may request correction or removal of their data at any time by contacting info@monkycards.de. Data will be removed from active display within 7 business days.

8. No Employment or Partnership

This Agreement does not create an employment relationship, partnership, joint venture, or agency between the Creator and MonkyCards. The Creator is an independent third party who has granted MonkyCards a limited license to use their likeness.

9. Limitation of Liability

MonkyCards makes no guarantee regarding the commercial success of a Creator's card, the number of cards sold, or the long-term visibility of the Creator on the platform. MonkyCards is not liable for any loss of opportunity, revenue, or reputation arising from the Creator's participation on or removal from the platform.

10. Governing Law

This Agreement is governed by German law. Disputes shall be subject to the jurisdiction of the competent courts in Germany, without prejudice to any mandatory rights the Creator may hold in their country of residence.

11. Amendments

MonkyCards reserves the right to update this Creator Agreement. Creators will be notified of significant changes by email and will be given the opportunity to accept updated terms or request removal from the platform.

12. Acceptance

By submitting an application via the Apply as Creator form on monkycards.com and confirming acceptance, the Creator agrees to be bound by these terms.
