2. Scope

These Terms & Conditions apply to all purchases of digital collectible cards made through the MonkyCards website (monkycards.com). By completing a purchase, you agree to these terms in full.

3. The Product — What You Are Buying

MonkyCards are limited-edition digital collectible cards, each representing a real content creator at an early stage of their career. Each card is strictly limited to 25 copies per creator (Founder Edition).

When you purchase a MonkyCard, you receive:

• A unique, numbered digital collectible card assigned to your Collector Profile
• A permanent entry on the MonkyCards Collector Wall
• Access to future features, including the trading marketplace (coming soon)

MonkyCards are digital goods. They are not physical items and cannot be delivered by post.

4. Collector Profile

Upon completing your first purchase, a Collector Profile is automatically created using your name and email address. You do not need to manually register. You are responsible for keeping your login credentials secure. If you believe your account has been compromised, contact us immediately at info@monkycards.de.

5. Pricing and Payment

All prices are displayed in USD. The price at the time of purchase is final. Payment is processed exclusively through Stripe and PayPal. MonkyCards does not store your payment details. As a small business under § 19 UStG, MonkyCards does not charge VAT.

6. Delivery

Upon successful payment, your card will be assigned to your Collector Profile within 24 hours. You will receive a confirmation email at the address provided at checkout.

8. Right of Withdrawal — Digital Goods

Under EU consumer law (Directive 2011/83/EU), you generally have a 14-day right of withdrawal for online purchases. However, the right of withdrawal does not apply to digital content that has already been delivered where you have expressly consented to immediate delivery.

By completing your purchase on MonkyCards, you expressly agree to immediate delivery of your digital card and acknowledge that your right of withdrawal is forfeited upon delivery.

For customers outside the EU: please refer to the return and cancellation policies applicable in your jurisdiction. Contact info@monkycards.de with questions.

9. Trading Marketplace (Coming Soon)

A peer-to-peer trading marketplace is currently in development. Once live, collectors will be able to buy and sell cards with other users. Additional terms will be published before launch. MonkyCards reserves the right to charge a platform fee on marketplace transactions.

10. Intellectual Property

All content on the MonkyCards platform — including card designs, graphics, the MonkyCards logo, and website content — is the intellectual property of Christian Walter / MonkyCards and is protected under applicable copyright law.

As a collector, you receive a personal, non-exclusive, non-transferable license to display your MonkyCards within your Collector Profile and on the MonkyCards platform. You may not reproduce, distribute, or commercially exploit any MonkyCards content without prior written consent.

11. Creator Content and Conduct

MonkyCards features real content creators. We are not responsible for the content, actions, or public conduct of any featured creator after their card is issued. If a creator requests removal from the platform, their card will be retired from active sale. Existing card holders retain their cards.

12. Limitation of Liability

To the extent permitted by applicable law, liability is limited to cases of intent or gross negligence. We are not liable for:

• Loss in perceived or actual card value
• Interruptions to platform availability
• Actions or conduct of featured creators
• Technical issues caused by third-party services (Stripe, PayPal, IONOS)

13. Governing Law and Jurisdiction

These Terms & Conditions are governed by German law. For EU consumers, mandatory consumer protection provisions of your country of residence apply in addition. For US customers: nothing in these terms limits your rights under applicable state or federal consumer protection law.

14. Changes to These Terms

We reserve the right to update these Terms & Conditions. The version in effect at the time of your purchase applies to that transaction. We will notify existing users of significant changes by email.
